Generation Environment, PBC understands your concerns about privacy and your interest in knowing how your information is used and shared, and so we have created this Privacy Policy (the “Privacy Policy”) to provide you with more information on these topics.  This Privacy Policy describes the practices and policies for our website located at www.generationenvironment.com (the “Website”).  This Website is owned and operated by Generation Environment (hereinafter referred to as “Gen E,” or “we” or “us”).  This Privacy Policy applies only to Gen E’s online information-gathering and sharing practices occurring on the Website, and does not apply to any of our practices conducted offline.  By visiting this Website, you are accepting the practices and policies described in this Privacy Policy, and you are further indicating that you agree to be bound by the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy you should not visit this Website or use any of the “links” on this Website.  We may update this Privacy Policy from time to time, so please check this Privacy Policy periodically for changes. The date this Privacy Policy was last updated is stated at the end of this document.

THE INFORMATION WE COLLECT

Personal Information You Provide And How It Is Used: You may freely visit our Website anonymously and without being required to provide us with any personal information.  However, a few requests and features do require that you provide us with some personally identifying information as more particularly described below.  Personal information is data that can be used to identify or contact you.  

E-Newsletter:  If you opt to join our mailing list to receive the latest updates on news and events, we will ask you to provide your email address, and first and last name. You may unsubscribe from these emails at any time by using the link provided in the footer of all such emails.

Contact Us, Join Us: We do provide an option for visitors to email us, and we will collect your email address – and any other information you provide – if you do so.  We also provide a “join us” link that allows visitors to provide us with their email address and first name, as well as any other personal information you choose to share with us.  Please do not send confidential information to us directly via either of these options.

Non-Personal Information We Collect by Automated Means And How We Use It: We may also collect certain non-personal information (data in a form that does not support direct association with any specific person or individual) by automated means when you visit the Website.  Much of this information is collected through the use of third-party tracking services, which includes Google Analytics. The information collected may include usage information, such as the numbers and frequency of users to the Website, pages visited, web browsing histories, your location and device, social networking activities and similar data. When gathered, this data is used in the aggregate, and not in a manner that is intended to identify you personally. In addition to the third-party tracking services mentioned above, we may also collect this information through various other means, including “cookies” and IP addresses, as further explained below.

Cookies – A cookie is a piece of information that a web server may place on your computer when you visit a Website. Cookies are commonly used by websites to improve the user experience.  Many cookies last only through a single Website session, or visit. Others may have an expiration date, or may remain on your computer until you delete them. We may use “session cookies” in order to enhance the user experience and for other web-related purposes.  These session cookies are not linked to personally identifiable information.   Most browsers will tell you how to stop accepting new cookie, how to be notified when you receive a new cookie, and how to disable existing cookies.

IP Addresses – When you visit and interact with the Website, third parties with whom we have contracted to provide services for us may collect Internet Protocol addresses (each an “IP Address”), as well as browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and page navigation. An IP Address is a unique identifier number that certain electronic devices used to identify and to communicate with each other on the Internet; your Internet Service Provider automatically assigns an IP Address to the computer that you are using.  We gather this information to track Website visitor movement in the aggregate, and to gather broad demographic information for aggregate use. We may use this information to enhance our Website or for other lawful purposes.

HOW WE MAY SHARE YOUR INFORMATION

We may disclose all of the information (described herein) that we collect, as stated in this Privacy Policy including in accordance with the terms set forth in this section. Gen E works with a variety of third-party partners in order to allow us to make the Website available to you, to host and store the information we collect from you, and to provide certain functionality and features.

Except as stated in this Privacy Policy, we do not reveal personally identifiable information about you to third parties for their independent use unless: (1) you expressly authorize Gen E to do so, (2) it is necessary to allow Gen E and its service providers or agents to provide services on Gen E’s behalf, (3) it is to provide products or services to you, (4) it is disclosed to entities that perform marketing or data aggregation services for Gen E, (5) it is necessary in connection with a sale of all or substantially all of the assets of Gen E or the merger of Gen E into another entity or any consolidation, share exchange, combination, reorganization, or like transaction in which Gen E is not the survivor, (6) Gen E is required or permitted to do so for any or all of the following reasons: (i) to comply with a subpoena, legal process, government request or any other legal obligation, (ii) to prevent, investigate, detect, or prosecute criminal offenses or attacks on the technical integrity of the Website or our network, and/or (iii) to protect the rights, privacy, property, business, or safety of Gen E, its partners and employees or the visitors to the Website. 

CHILDREN’S PRIVACY/NOTE TO PARENTS

Our Website does not intentionally or knowingly collect, use, or disclose personally identifiable information about visitors to our Website who are less than 13 years of age. If a child under the age of 13 submits information to us through any part of the Website and Gen E becomes aware that the user submitting the information is under the age of 13, the information provided will be deleted as soon as it is discovered and not used for any purpose. If you are the parent or guardian of a child under 13 years of age and believe that they have disclosed personally identifiable information to us, please contact us support@generationenvironment.com and be sure to include in your message the name and email address that you believe your child submitted, if applicable.

THIRD PARTY WEBSITES/LINKS

We may also provide links to a variety of third-party social media sites and/or websites – such as Facebook, Twitter Instagram,  Pinterest – as a service to you, and in order to provide you i) additional information and/or content related Gen E, or ii) additional venues in which you can learn about and discuss the activities of Gen E.  Please note that we have no affiliation with any of these other websites, and cannot control and are not responsible for the information collection, use, and disclosure practices of such third parties. We encourage you to review and understand their privacy practices and policies, if any, before using providing any personally identifying information to them.  We are not responsible for the content or information of these websites, or any other use of the linked website. 

HOW WE ATTEMPT TO SAFEGUARD YOUR INFORMATION

We maintain – and ask that any third-party partners who may store information on our behalf to maintain – administrative, technical and physical safeguards for the Website designed to protect your personal information against theft, loss, misuse or unauthorized access, disclosure, alteration or destruction of the personal information that we collect from you.  We restrict access to personal information collected about you on the Website to our employees, our affiliates’ employees, those who are otherwise specified in this Privacy Policy, or others who need to know such information to provide services to you or in the course of conducting our business operations or activities. However, no website, application or transmission can guarantee security. Thus, while we have established and maintain what we believe to be reasonable procedures to protect the confidentiality, security, and integrity of personally identifying information obtained through the Website and we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us.  When you link to one of our social media venues, the personal information you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to submit in these instances, and understand, acknowledge, and agree that you transmit certain personal information over this Website at your own risk.

USE OF THE WEBSITE FROM OUTSIDE THE UNITED STATES

We do not represent or warrant that the Website, or any part thereof, is appropriate or available for use in any particular geographic location. If you choose to access our Website, you do so on your own initiative and at your own risk, and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. The Website is hosted in the United States and is governed by United States law. If you are visiting the Website from outside the United States, your information will be transferred to, stored and processed in the United States where our servers are located and our central database is operated. MOBILE APPLICATION PRIVACY POLICY

Generation Environment PBC (hereinafter, “Gen E”,” or “we” or “our”) owns and operates the Gen E mobile application (the “App”).  The App provides you the ability to contribute a small portion of your purchasing transactions (micro-philanthropy) towards environmental philanthropic causes/nonprofits; the App provides a selection of nonprofits from which you can choose. We understand your concerns about privacy and your interest in knowing how your information is used and safeguarded, and we want to provide you with more information on these topics.  This privacy policy (the “Policy”) is intended to provide you with information regarding our policies and practices related to the information we collect through the App, including the types of personal information we collect on the App, how we may use that information, and with whom we may share it. Please note that this Policy applies only to our information-gathering, processing and sharing practices through the App, and therefore it does not apply to any of the information (and related practices) that we may collect via other means, methods or channels – such as offline, the Gen E website, or any other means. If after reading the Policy you have additional questions or would like further information on this topic, please email us at support@generationenvironment.com.  We may update this Privacy Policy from time to time, so please check this Privacy Policy periodically for changes. 1. What Information Does the App Collect, and How is it Used?

Personally Identifiable Information: You can download the App to your mobile device without having to provide us with any personally identifying information.  However, if you want to use the App to contribute to environmental philanthropic causes, you will need create an account (the “Account”).   If you register and create an Account, you will be asked to provide some personally identifiable information, including your name, email, phone number, and profile photo. You will also be asked to provide a user name – please note that by default your user name will be your first and last name, and – will be publicly displayed when you use the App – so if you prefer more anonymity you should edit your user name at the time you setup your account, or anytime thereafter.  In regard to the information that we collect when you register, we sometimes use this information to communicate with you on various matters, or as further described in this Policy. 

Additionally, in order to make philanthropic contributions, you will need to provide your credit card information.  Please note that we use Stripe, Inc. to collect your credit card information. You will also be asked to connect your Account to your financial institution, and we use Plaid, Inc. to manage that connection, and to track your credit card transactions.  We encourage you to review the privacy policy and related terms of both Stripe and Plaid  prior to providing us with such information.   Once your account is setup, we will also track your purchases/transactions for purposes of supporting your micro-philanthropic contributions. 

Finally, if you opt to make a “spot donation” – which is  one-time donation to one of the nonprofit organizations accessed via the App – you will have the option to share your name and email address with the nonprofit you have supported with the spot donation.  If you choose to share your name and email address, please note that the nonprofit will use that information for their own purposes, so we encourage you to review their privacy policy if you have any questions or concerns. 

Non-Personally Identifiable Information: The App may collect certain non-personally identifiable information automatically from your use of the App and its functions in order to allow us to monitor and improve the user experience, and diagnose issues.  We may collect this information ourselves, or through third-party analytic services such as Google Analytics.  A representative, non-exhaustive list of the types of non-personally identifiable information collected may include: the mobile network you are using, your internet protocol address, operating system, screen size and other default system operations.  Additionally, we may use such technologies like cookies (small files stored by your mobile web browser or “webview”), beacons, or unique device identifiers to identify your mobile device.  We may use this information internally to help us provide you with a more personalized user experience. We also track usage events in the App, and if you register then we may tie that usage with personally identifiable information; usage may also be linked to a particular mobile operating system, app version, and mobile device.  We do not resell or redistribute this information for commercial gain, and all of this information is stored in your account in a database that is hosted by Gen E.  

2. Does the Application Collect Precise, Real Time Location Information?

No, this App does not collect precise real-time location information of your mobile device. 

3. Do Third Parties See and/or Have Access to Information Obtained by the App?

We may disclose all of the information (described herein) that we collect, as stated in this Policy, including in accordance with the terms set forth in this section. Gen E works with a variety of third-party partners in order to allow us to make the App available to you, to host and store the information we collect from you, to process and disburse donations, and to provide certain functionality and features. 

Other than as described in this Policy, we will not be providing third parties with access to information obtained by the App. When we do share your information with any such third parties, we will share such information pursuant to the obligations described in this Policy.  Additionally, we may disclose both personally and non-personally identifiable information as follows:

–   as required by law, such as to comply with a subpoena or similar legal process;

–   when we believe in good faith that disclosure is necessary to protect Gen E’s rights, protect your safety or the safety of others, investigate fraud, or to respond to a government request;

–   with service providers who work on behalf of Gen E, such as the Gen E application developers and technical team;

–   if we are involved in any type of organizational change, in which case you will be notified via email or notice on the App of any change of ownership, and you will also be informed of any choices you may have regarding the use of your information at that time.

4.  Advertising & Marketing.

The App will not be serving advertisements, and we will not share your name and/or personal information with unrelated, third-party marketers. 

5. Opt-Out Rights.

You can stop us from collecting information via the App by uninstalling, deleting or otherwise removing the App from your mobile device.  In such cases, any information that you have provided to us will be retained, and eventually deleted, in time, consistent with our standard data-retention policy, as further noted below.

6. Data Retention Policy; Managing Your Information.

We will retain any user-provided data for as long as you use the App and for a reasonable time thereafter.  If you would like to request that we delete the personally identifiable information that you have provided to us via the App, please contact us at  support@generationenvironment.com and we will endeavor to respond to any commercially reasonable requests within a reasonable timeframe. 

7. Children.

The App is not intended for use by children, and we do not knowingly or intentionally solicit data from or market to children under the age of 13. Additionally, as specified in the Terms of Use, those individuals who are older than 13 years of age but less than 18 years of age are only permitted to use the App with parental/guardian consent and supervision. If you are a parent or guardian and become aware that your child has provided us information without your consent, please contact us at support@generationenvironment.com to request that we delete such information.  We will delete such information from our files within a reasonable amount of time from your request.

8. Security.

Your privacy is important to us, and we have put in place security systems designed to prevent unauthorized disclosure and use of your private information.  In the case of any third-party providers, we have asked for similar assurances. The security systems in place are structured to deter and prevent hackers and others from accessing your information. Due to the nature of Internet communications and evolving technologies, however, we cannot provide, and disclaim, assurance that such information and communications will remain free from loss, misuse, or alteration by human error or third parties who, despite our security measures efforts, may obtain unauthorized access. 


9.  Changes.

We reserve the right to change, alter, replace, revise or otherwise modify this Policy at any time. The date of last modification is stated at the end of this Policy. It is your responsibility to check this page from time to time for updates.  If we make any material changes to this Policy – as determined by us, in our sole discretion – then we may provide notice of such change via the App or will email you using the email you provided to us when you registered; your continued use of the App after such notice will indicate your acknowledgement and agreement with any and all such changes.  This Policy is not intended to and does not create any contractual or other legal right in or on behalf of any party.

10. Your Consent.

By using the App, you are consenting to our processing of your information and the collection of other information and data by the App, as further described in this Policy. You acknowledge that in regard to any third-party providers referenced in this Policy we exercise no control over their policies, procedure or practices, and we specifically disclaim any representations, warranties or assurances thereof. 

We do not represent or warrant that the App, or any part thereof, are appropriate or available for use in any particular geographic location. If you choose to use the App, you do so on your own initiative and at your own risk, and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. We reserve the right to limit the App’s availability, in whole or in part, to any person, geographic area, or jurisdiction we choose, at any time and in our sole discretion. If you are using the App from outside the United States, please be aware that your information may be transferred to, stored or processed in the United States, where the App is hosted and where the database resides.  The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that we take steps to protect your privacy as further detailed in this Policy. By using the App, you understand that your information may be transferred to those facilities and those third parties with whom we share it as described in this Policy.

11. Transaction Monitoring.

Please note, that by registering a payment card (e.g., debit card or credit card) in connection with your use of the App, we will monitor and track your transactions in order to fulfill your micro-philanthropic designations.
